Introduction

This agreement sets out the Terms of Service ('Terms of Service') applicable to members of the service operated by BidBox ('Site'). Applicants (referred to as 'members') must agree to the following Terms of Service. In the event a member fails to comply with any provision of these Terms of Service then in addition to any other remedy available to BidBox, BidBox may terminate the participation of such member in the service.

Eligibility

Bidbox.me shall have absolute discretion as to membership and participation in the service.

Violation of Terms

Bidbox.me reserves the right to terminate the participation of any member or site without reason but expressly including any member site that BidBox judges to be in violation of the Terms of Service.

Members who violate BidBox's Terms of Service will be immediately suspended. BidBox reserves the right to suspend members without notice. Members who violate of the Terms of Service will not receive compensation from BidBox.

Disputes

Members may not file a complaint with any payment gateway used by BidBox, including PayPal, regarding the funds processed through Bidbox. BidBox will do its best to resolve any problems. Refunds will be processed at the discretion of the BidBox staff. Members who file complaints with parties involved in payment processing other than BidBox may face account suspension without prior notification.

Copyrights

Members may not post any copyrighted material on BidBox. Members who post copyrighted material will have accounts suspended without notice. BidBox's staff will do its best to ensure no copyrighted material is posted; however, BidBox and its employees are not responsible for any copyrighted material posted.

Modification of Terms

BidBox reserves the right to change the member Terms of Service at any time. It is the member's responsibility to check these Terms of Service from time to time for such changes.

Ownership

Members grant that all information contained on BidBox, and all information compiled by BidBox, is the property of BidBox. Personal information provided by members to BidBox will be kept confidential and will not be distributed to any third party. BidBox will abide by its Privacy Policy for use of information collected.

E-Mail Addresses

Members agree not to share their e-mail address on the site, except in the "e-mail" field of the signup form, or when asked by BidBox. Members agree not to share their email address with any BidBox user as it is automatically provided as needed through the normal operation of the site. This applies not only to email addresses, but also to all forms of electronic communication, including instant messaging screennames.

Sharing Contact Information

Members agree not to contact another BidBox member outside of the methods provided on BidBox, unless it's for a project you (a designer) have been picked for, or you (a buyer) have chosen the designer for. This includes the sharing of your e-mail address, instant messaging screenname, phone number, or any other form of contact outside of BidBox.

Projects

BidBox reserves the right to approve all new projects and remove projects at will.

Bidding

Designers cannot post an hourly bid or any other abnormal type of bid. Buyers also cannot create projects that directly or indirectly require designers to place hourly or other abnormal bids.

Advertising

You are prohibited from promoting your website on BidBox. Any URL posted in a bid, project description, or the message board, must directly relate to a project on BidBox. A portfolio pages is an example of an acceptable link.

Accounts

An individual may not create more than one Designer account and one Client account, unless they have been given permission by the BidBox staff. Individuals found with unapproved multiple accounts for any purpose may face termination of all their accounts without notice. Members are not allowed under any circumstance to transfer ownership of an account without prior approval from BidBox staff. Accounts not logged into for a period of 12 months or more may be suspended and have their remaining credits removed by BidBox.

The Role of BidBox

BidBox is a platform for connecting buyers and designers in a virtual marketplace. As a neutral party, BidBox is not directly involved in the actual transactions between users of the Site. As a result, BidBox has no control over the truth, accuracy, quality, legality, or safety of postings made by users. BidBox cannot and does not confirm the identity of users. BidBox does not confirm and is not responsible for the qualifications, background, or abilities of Members, or for the outcome of projects. BidBox is not responsible or liable in any way for financial loss due to transactions that take place on the Site, or for fraudulent payments made by Members. Members are responsible for the transactions that take place on the Site. It is the Member's responsibility to verify the truth and identity of all transactions and other members on the Site.

Legal

Members are responsible for legal issues related to the work product or process and any postings on BidBox. This site is governed by the laws of the State of Wisconsin, United States of America. Any legal action against us shall take place in the courts of the State of Wisconsin, United States of America. The parties agree to the non-exclusive jurisdiction of the courts of the State of Wisconsin, United States of America.
